Green Gems Does Not Sell Your Personal Data

We process user data to run the platform, provide requested features, and maintain service security.

1. Acceptance and binding effect

By creating an account, logging in, or using the Green Gems website, applications, or services (“Service”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use the Service. Your continued use constitutes acceptance of any future changes we post.

2. No investment or financial advice

Nothing on the Service constitutes investment advice, financial advice, trading advice, legal advice, or tax advice. All content, data, quotes, charts, alerts, and tools are provided for informational and educational purposes only. You are solely responsible for your own investment, trading, and financial decisions. We do not recommend any security, strategy, or action. Past performance is not indicative of future results. You may lose capital. We are not registered as investment advisers, broker-dealers, or in any regulated capacity in any jurisdiction.

3. No warranty; “as is”

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that data (including market data, quotes, or third-party feeds) is accurate, complete, timely, or uninterrupted. Delays, errors, and omissions may occur. Your use of the Service is at your sole risk.

4. Limitation of liability

To the maximum extent permitted by applicable law, Green Gems, its operators, affiliates, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or trading losses, arising from or in connection with your use or inability to use the Service, even if we have been advised of the possibility of such damages. In no event shall our aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred Indian Rupees (INR 100), whichever is less. These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

5. Indemnification

You agree to indemnify, defend, and hold harmless Green Gems, its operators, affiliates, officers, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms or any law; (c) your violation of any third-party right; or (d) any dispute between you and any third party relating to trading, investments, or use of data obtained via the Service. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you.

6. Acceptable use; no abuse

You must not use the Service to: (a) violate any applicable law or regulation; (b) infringe any intellectual property or other rights; (c) transmit malware or harmful code; (d) attempt to gain unauthorized access to our systems, APIs, or other users’ accounts; (e) scrape, harvest, or automate access in a manner that exceeds normal use or that we have not expressly permitted; (f) resell, sublicense, or commercially exploit the Service or data without our prior written consent; (g) use the Service for any illegal or fraudulent purpose. We may suspend or terminate your access immediately, without notice or liability, for any breach or suspected breach of these terms.

7. Account and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We are not liable for losses resulting from unauthorized use of your account.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.

9. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Delhi and the National Capital Region (NCR). You waive any objection to venue or forum. To the extent permitted by law, you waive any right to participate in class actions.

10. Changes

We may modify these Terms at any time by posting the updated version on the Service. Your continued use after changes constitutes acceptance. It is your responsibility to review these Terms periodically.

11. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
